Terms of Service

By enquiring about, booking, or attending tutoring sessions with EquateIt Pty Ltd (ABN: 25 695 632 350) ("EquateIt", "we", "us", or "our"), you agree to be bound by the following Terms of Service. These terms apply to students, parents, and guardians ("you" or "your").

If EquateIt makes material changes to these Terms, we will notify you by email before the changes take effect.

A. Booking and Scheduling

  • All sessions are booked through the ClassQuill platform or via direct arrangement with your tutor.
  • Booking confirmation is sent by email. Sessions are not confirmed until you receive this confirmation.
  • You are responsible for ensuring the student attends or joins the session at the agreed time and location.
  • EquateIt reserves the right to reassign or substitute a tutor where the originally assigned tutor is unavailable, with reasonable notice.

B. Cancellation and Rescheduling

  • Cancellations made at least 24 hours before the session will not be charged.
  • Cancellations made within 24 hours of the session may be charged at the full session rate at EquateIt's discretion.
  • No-shows (failing to attend without notice) will be charged at the full session rate.
  • EquateIt or the assigned tutor may cancel a session with reasonable notice. In this case, no charge is applied and we will offer an alternative time.
  • Repeated last-minute cancellations may result in termination of the tutoring arrangement.

C. Payment

  • Sessions are billed per session or per term as agreed at the time of booking.
  • Payment is due within 7 days of the invoice date unless otherwise agreed.
  • All fees are in Australian dollars (AUD) and are GST-inclusive.
  • EquateIt does not store payment card details. Bank transfer is the standard payment method.
  • Overdue invoices may result in suspension of upcoming sessions until payment is received.

D. Rates and Price Changes

  • Current rates are published at equateit.com.au/pricing. Rates may vary by subject and year level.
  • EquateIt may update rates with 30 days' written notice. Existing bookings confirmed before the notice period are honoured at the previous rate.

E. Service Delivery

  • EquateIt will make reasonable efforts to match students with a tutor who is qualified in the requested subject and year level.
  • Online sessions require a stable internet connection and suitable device on the student's side. EquateIt is not responsible for technical issues on the student's end.
  • In-person sessions are conducted at a location agreed between the tutor and client (typically the student's home or a public space).
  • EquateIt does not guarantee specific academic outcomes. Results depend on the student's engagement, effort, and the nature of the subject matter.

F. Working With Children

  • All EquateIt tutors hold a valid Victorian Working With Children Check (WWCC) or equivalent, as required by the Child Wellbeing and Safety Act 2005 (Vic).
  • EquateIt maintains a record of current WWCC status for all active tutors and does not permit tutoring to commence without a valid check.

G. Conduct

  • All parties — students, parents, and tutors — are expected to treat each other with respect. Abusive or threatening behaviour will result in immediate termination of the arrangement with no refund.
  • Students must not engage tutors through EquateIt for purposes outside the agreed tutoring scope.
  • Direct private arrangements between a client and a tutor introduced through EquateIt during or within 12 months of their EquateIt engagement are not permitted without our prior written consent.

H. Intellectual Property

  • All materials provided by EquateIt — including practice questions, worksheets, and platform content — remain the intellectual property of EquateIt Pty Ltd or our licensors.
  • Materials are provided for the student's personal educational use only and may not be reproduced, shared, or resold.

I. Limitation of Liability

  • To the maximum extent permitted by law, EquateIt's liability for any claim arising from the provision of tutoring services is limited to the total fees paid for the relevant session(s).
  • EquateIt is not liable for any indirect or consequential loss, including loss of academic opportunity or exam results.
  • Nothing in these Terms excludes any rights you may have under the Australian Consumer Law (Competition and Consumer Act 2010, Schedule 2) that cannot be excluded by contract.

J. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of Victoria.
